1. General
These terms and conditions apply to all services provided by Brad Ward Motors Ltd ("we", "us", "our") at our workshop located at 10A Moselle Ave, Henderson, Auckland 0610, New Zealand.
By requesting or authorising work on your vehicle, you agree to be bound by these terms. If you do not agree, please let us know before any work commences.
2. Quotes and Authorisation
- We will provide a quote or estimate before commencing any work, wherever practical.
- Quotes are valid for 14 days from the date of issue unless otherwise stated.
- If additional work is identified during the course of repairs, we will contact you for approval before proceeding. We will not carry out work beyond the original scope without your authorisation.
- Verbal or written (including email and text message) authorisation is accepted.
3. Payment Terms
- Payment is due in full upon collection of your vehicle unless prior arrangements have been made.
- We accept Visa, Mastercard, EFTPOS, cash, and bank transfer.
- Vehicles will not be released until payment has been received in full.
- We reserve the right to charge interest on overdue accounts at a rate of 2% per month.
- In accordance with the Customs and Excise Act 2018 and related legislation, we retain a lien over your vehicle until all charges are paid.
For WINZ-assisted repairs, we will work with your case manager. Payment terms may vary in these circumstances, please discuss this with us at the time of booking.
4. Warranty
- We offer a 12-month warranty on our workmanship, subject to normal use and manufacturer conditions.
- Labour associated with warranty claims on parts we have supplied and fitted is covered for 12 months or 20,000 km, whichever comes first.
- Warranty does not cover damage caused by misuse, neglect, accident, or modification by a third party.
- Customer-supplied parts are not covered by our warranty. We accept no liability for the failure of parts supplied by the customer.

5. Bookings and Cancellations
- Bookings can be made by phone, email, or through our online booking system.
- We ask that you provide at least 24 hours' notice if you need to cancel or reschedule a booking.
- We understand things come up and will always try to accommodate changes. However, repeated no-shows may affect future booking availability.
- Drop-offs and walk-ins are welcome, but booked customers will be given priority.
6. Vehicle Collection
- We will notify you when your vehicle is ready for collection.
- Vehicles should be collected within 3 working days of notification. After this period, a reasonable daily storage fee may apply.
- Vehicles left on our premises are left at the owner's risk. While we take reasonable care, we are not responsible for loss or damage caused by events beyond our control (such as severe weather or theft).
7. Limitation of Liability
Our liability is limited to the cost of the services provided. To the maximum extent permitted by New Zealand law:
- We are not liable for any indirect, consequential, or incidental loss or damage arising from our services, including loss of use, loss of income, or inconvenience.
- We are not responsible for pre-existing faults, wear and tear, or issues unrelated to the work we have carried out.
- Nothing in these terms limits or excludes any rights you may have under the Consumer Guarantees Act 1993 that cannot be lawfully excluded.
We carry full public liability and professional indemnity insurance for the protection of our customers.
8. Test Drives
We may need to test drive your vehicle as part of the diagnostic or repair process. Our staff are experienced professionals and will treat your vehicle with care. Test drives are covered by our insurance.
9. Personal Belongings
Please remove all valuables and personal belongings from your vehicle before leaving it with us. We accept no responsibility for loss of or damage to personal items left in vehicles.
10. Dispute Resolution
If you are unhappy with any work we have carried out, please speak to us first. We are committed to resolving any issues promptly and fairly. As an MTA approved workshop, disputes may also be referred to the Motor Trade Association for mediation.
11. Governing Law
These terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
